The West Virginia Legislature has enacted Senate Bill Number 18, 1991, (The West Virginia Recycling Act, West Virginia Code 20-11-1 ET SEQ) stipulating that each municipality has the authority and duty to assure proper and adequate transportation, collection, and storage of municipal waste which is generated or present within its boundaries and to adopt and implement programs for the collection and recycling of municipal solid waste or source-separated recyclable materials.
