Any person, firm, corporation, or organization notified of non-compliance with this Article or required to perform monitoring, analyses, reporting and/or corrective activities who is aggrieved by the decision of the Director may appeal such decision in writing to the Municipal Court of the City of Martinsburg within ten (10) days following the effective date of the decision. Upon receipt of such request, the Court shall request a report and recommendation from the Director and shall set the matter for hearing at the earliest practical date. At said hearing, the Municipal Judge may hear additional evidence, and may revoke, affirm or modify the earlier decision. Such decision shall be final, subject to appeal to The Circuit Court of Berkeley County.
