909.06 LIABILITY INSURANCE.
   (a)   Requirements. The certificate of insurance required of the applicant under Section 909.03(b) shall indicate that he is insured against claims for damages for personal injury as well as against claims for property damages which may arise from or out of the performance of the work, whether such performance by the permittee, his subcontractor or anyone directly or indirectly employed by him. Such insurance shall include protection against liability arising from completed operations. Such insurance shall provide complete third party coverage for the City of Martinsburg. The amount of such insurance shall be prescribed by the Manager in accordance with the nature of the risks involved; provided, however, that the liability insurance for bodily injury in effect shall be in an amount not less than one hundred thousand dollars ($100,000) for each person and three hundred thousand dollars ($300,000) for each accident, and for property damages in an amount not less than fifty thousand dollars ($50,000). Failure of applicant to file such certificate shall be grounds for denying a permit; provided, however, that City departments, franchised public utilities and other governmental agencies may be relieved of the obligation of submitting such a certificate if they do the work contemplated under the permit with their own personnel or with a contractor insured as required; however, such waiver shall not release any such organization from any and all liability under any of the obligations provided herein.
