§ 92.05 UNCONTROLLED OUTDOOR BURNING PROHIBITED; EXCEPTIONS.
   (A)   Prohibitions. It is unlawful for a person to cause, suffer, allow or permit any uncontrolled outdoor burning of rubbish, garbage, brush, combustible materials or solid waste within the city limits or the ETJ of the city.
   (B)   Exceptions. The provisions of this chapter shall not apply to the following:
      (1)   Outdoor burning in connection with the preparation of food;
      (2)   Campfires and fires used solely for recreational purposes or for ceremonial occasions;
      (3)   Domestic burning for heat and cooking within any dwelling unit when contained in an approved fireplace. Barbeque pits, smokers, liquid propane cookers or similar open flame cooking equipment shall not be used within ten feet of any structure; or
      (4)   Burning within an incinerator constructed and maintained in accordance with the most current editions of the standards and specifications of the National Fire Protection Association. Burning for the purpose of property development or land clearing operations shall be by trench burner or air curtain operations.
