§ 130.030 INTOXICATION; OPEN CONTAINERS.
   (A)   Intoxication; simulated intoxication in a public place. It is unlawful and an offense against the peace and dignity of the city for any person to be intoxicated or simulate intoxication in a public place.

   (B)   Open containers prohibited on public ways.
      (1)   It shall be unlawful for any person to possess an open or unsealed bottle, can, jar or other receptacle containing an alcoholic beverage on any public sidewalk, street, alley or parking lot, or within a motor vehicle.
      (2)   The Council shall have the power to grant exceptions to this division (B) for special events and activities. Exceptions may be granted after City Council review and approval by resolution.
