§ 50.28 RESTRICTION ON FEES.
   (A)   Garbage, waste, and recycling haulers, so licensed, shall be entitled to charge a flat monthly fee not to exceed $20 beginning November 1, 2018, and all licensed waste haulers operating within the city shall provide curbside recycling service to their customers at no additional charge to the customers.
   (B)   Notwithstanding any of the foregoing to the contrary, all garbage bags, cans or other containers in excess of two 30-gallon cans, bags or containers, or the equivalent thereof, per week, or one 30-gallon can, bag or container or the equivalent thereof, and one large item as defined herein, shall have affixed thereto garbage collection stickers of the city, which stickers shall be provided by each licensee hereunder at an amount not to exceed $1.25 each. The stickers shall be sold by the said licensees and/or their duly designated agents at convenient location(s) within the city.
   (C)   Multi-family units or commercial establishments may negotiate a fee with their licensed contractor-hauler due to special requirements for containers or service such facilities may have.
   (D)   In the event the state or any other unit of government increases the fees assessed to the sanitary landfill operator and as a result of the increased fees, the sanitary landfill operator increases the tipping fee to licensee, the licensee may increase the monthly fee to its customers resulting from any such increase upon the express consent of the city.
   (E)   In the event the state or any other unit of government decreases or eliminates any of the current fees assessed to the sanitary landfill operator and as a result of the decrease or elimination of assessed fees the landfill operator decreases the tipping fee to the licensee, then the monthly amount charged by the licensee as authorized by this subchapter shall be reduced in an amount equal to the decrease in tipping fees.
   (F)   No person, firm or corporation licensed pursuant to the provisions of this subchapter shall collect any fees for recycling and/or refuse collection services in excess of the fees authorized by this subchapter without first obtaining the express consent of the City Council following a public hearing for the purpose.
