(A) The failure to comply with any requirement of this Chapter 100, Vacant Buildings shall be subject to a fine according the Uniform Fine Schedule in “§ 10.99, General Penalty.” A separate offense shall be deemed committed upon each day during which a violation occurs or continues.
(B) The failure to abide by this Chapter 100, Vacant Buildings shall be considered a bases for the city requesting and obtaining an administrative search warrant to enter a building for health safety and general welfare purposes, to inspect for ordinance violations and nuisance conditions to treat and remediate any nuisance conditions or as a basis to seek any equitable remedy.
(C) The failure to abide by this Chapter 100, Vacant Buildings shall be a considered a basis for the city filing an action to remediate a nuisance as defined in Chapter 95: Nuisances of the Code of Marseilles.
(D) Any violation of this chapter also constituting a violation of any other section of the Code of Marseilles or Marseilles Zoning Ordinance may be enforced by any means otherwise authorized by the Code of Marseilles or Marseilles Zoning Ordinance.
(E) The Building Inspector may grant an extension of time to time limits established in this Chapter 100: Vacant Buildings if made in writing and incorporated into the terms of building permit or demolition permit.
(F) The listing for sale of a vacant property shall not be an affirmative defense against the City enforcing the requirements of this Chapter 100: Vacant Buildings.
