§ 10.99 GENERAL PENALTY.
   (A)    Uniform fine schedule. Unless another penalty is specifically provided by this code for violation of any particular provision, any person violating any provision of this code, or any rules or regulation adopted or issued in pursuance thereof, or any provision of any code adopted herein by reference, shall upon conviction be subject to the following Uniform Fine Schedule:
 
UNIFORM FINE SCHEDULE
In the case of a first violation of a particular provision, the defendant shall be fined
no less than $300 and no more than $750 plus court costs.
In the case of a second violation committed within five years of the same particular provision, the defendant shall be fined
no less than $600 and no more than $750 plus court costs.
In the case of a third or further violation committed within five years of the same particular provision, the defendant shall be fined
$750 plus court costs.
Each act of violation and each day upon which a violation occurs constitutes a separate offense.
 
   (B)   (1)   Notwithstanding the provisions of division (A) above or of any other section or provision of this code, the following penalty provision and procedure shall apply to all violations of this code except as otherwise indicated.
      (2)   A written notice of violation shall be issued to the individual or person or entity who has been alleged to have violated any provision of the code of ordinances. The notice of violation shall contain the name and address of the violator; the section of the code alleged to be violated; the date, time and location of the violation; the make, license number, and other relevant information for any motor vehicle involved; the name and identification of the complainant; a specific due date; together with a statement that the violation may be resolved without a court appearance upon payment of a pre-filing penalty paid on or before the due date. The pre-filing penalty shall be one-half of the minimum fine indicated for such violation, or if there is no stated minimum fine for such violation, then half the amount indicated in the Uniform Fine Schedule.
   (C)   The penalty provided by this section applies to the amendment of any section of this code or a code adopted herein by reference, whether or not such penalty is reenacted in the amendatory ordinance.
