931.01 COLLECTION, DISPOSAL AND FEES FOR MISCELLANEOUS REFUSE.
   (a)   Whenever that individual designated by the Town for collection and disposal of refuse identifies refuse of a miscellaneous nature not for the usual collection and disposal, that person is authorized to designate such refuse as miscellaneous and subject to special collection and disposal with a fee for such service.
   (b)   Such fee shall amount to one hundred dollars ($100.00) paid to the Town in advance, and the Town’s designee shall notify the person responsible for the miscellaneous refuse the fee amount and establish a written record of such notification. Such notification shall also be provided to the owner(s) of the real property associated with the miscellaneous refuse.
   (c)   No collection and disposal of the subject refuse shall occur if the individual or entity responsible is delinquent on any other of the fees or taxes of the Town.
   (d)   Should the fee not be paid in advance of collection and disposal of miscellaneous refuse, the Town’s designated individual at his or her discretion may elect to have the subject miscellaneous refuse collected and disposed.
   (e)   Upon collection and disposal of miscellaneous refuse without payment, advance or otherwise, the Town shall provide by certified mail, return receipt requested, to the persons responsible for the miscellaneous refuse, including the owner(s) of the real property, notice of the amount of the fee for the collection and disposal of the subject miscellaneous refuse. This Notice shall state unless the fee is paid within ninety (90) days from the date the Notice is mailed, the Town shall file a lien against the real property for the amount of the fee and any other costs to which the Town may be entitled including, but not limited to, interest and attorney fees.
   (f)   This Notice shall also state an administrative procedure of a right to appeal this matter to the circuit court in which the subject real property is located.
