This article is enacted to remedy nuisance activities that repeatedly occur or exist at chronic nuisance properties by providing a process for abatement, and this remedy is not an exclusive remedy available under any state or local laws and may be used in conjunction with such other laws as well as the common law. Specifically, it is recognized 8-12-5(23) of the West Virginia Code permits a municipality to provide for the elimination of hazards to public health and safety and to abate or cause to be abated any thing which in the opinion of a majority of the governing body of that municipality constitutes a public nuisance.
