505.06 CATS.
   (a)   Definitions. For the purpose of this section, the term “cat” shall mean cats of either sex, unless otherwise specified.
   (b)   Enforcement Duties. The Humane Officer, Police Officer or their authorized agent, or agents of the Town of Marmet shall enforce the provisions of this section. All such officers or their agents shall be authorized to issue citations to persons accused of violating any provisions of this ordinance and said citation shall be returnable to the Marmet Municipal Court in the same manner as traffic violations.
   (c)   Roaming at Large. No owner or keeper of any cat shall permit it to roam at large within the Town of Marmet at anytime, except on the property owned or occupied by the owner of such cat.
   (d)   Noisy Cats. No person shall own or keep within the Town of Marmet any cat, which shall by squalling, crying or in any other manner whatsoever disturb the peace and quiet of any neighborhood.
   (e)   Penalties, Releasing of Trapped Cats; and Redemption of Impounded Cats.  
      (1)   Any cat found roaming at large is in violation of the ordinance shall be seized and humanely removed by the Humane Officer, Police Officer or their authorized agent or agents by the use of traps or other devices. Once seized only the Humane Officer, Police Officer or their authorized agent or agents are permitted to release any trapped cat. Any person, other than those permitted to by this ordinance, releasing the trapped cat shall be in violation of this ordinance. If the ownership of the cat is not resolved, the cat shall be transported by the said Humane Officer, Police Officer or their authorized agent or agents to an animal shelter or facility. The owner of a cat which has been seized, trapped, or impounded as provided herein shall be entitled to redeem the cat during the five day period by paying the cost of impoundment, plus any fines imposed by the Town of Marmet.
      (2)   Whoever violates any provision of this ordinance shall be deemed guilty of a misdemeanor and fined not more than one hundred dollars ($100.00). Each day such violation continues, said violation shall constitute a separate offense.
