361.14 OVERWEIGHT AND OVERSIZED VEHICLES ON PRIVATE PROPERTY.
   (a)   Not withstanding the provisions contained in Article 347 prohibiting/limiting the use of the public streets within the Town of Marmet by overweight/oversized vehicles, the Mayor may issue a special permit in writing authorizing the owner and/or operator of an overweight and oversized vehicle who is a resident of the Town to park or store said overweight and/or oversized vehicle belonging to that owner/operator on the owner/operator’s private property within the Town; provided however, said special permit, in writing, so authorizing the parking/storage of an overweight and/or oversized vehicle shall be valid for a period of six (6) months only from the date on which it is issued. Upon expiration of the permit, the owner/operator must make another application to the Mayor for a new permit.
   (b)   Notwithstanding the provisions of paragraph (a) herein, owners/operators of overweight and/or vehicles who have obtained a permit from the Mayor to park their overweight and/or oversized vehicles on private property belonging to them must adhere to the following conditions:
      (1)   All overweight and/or oversized vehicles must be parked completely off all public streets, sidewalks, walkways and/or any other property belonging to the Town of Marmet.
      (2)   Any overweight and/or oversized vehicle for which a permit is issued shall not be parked in a manner which would obstruct the view of other motor vehicles using any public street within the Town and shall not be parked in a manner which would block public sidewalks, walkways or any other property belonging to the Town.
      (3)   Any owner/operator who has obtained a permit for storage or parking of an overweight and/or oversized vehicle on private property shall not run the engine or idle said overweight and/or oversized vehicle between the hours of 10:00 p.m. through 6:00 a.m. and at no time shall any owner and/or operator run the engine or idle said overweight and/or oversized vehicle for a period of longer than 15 minutes at one time.
      (4)   Any owner/operator who has obtained a permit for storage and/or parking of an overweight and/or oversized vehicle on their private property if fully responsible for any damage to the public streets, sidewalks, walkways or any other Town property due to the aforesaid storage and parking of said overweight and/or oversized vehicle and is further fully responsible for any damage to said public property due to fuel and/or oil spills and/or leaks from the aforesaid overweight and/or oversized vehicle.
   (c)   In the event any provision of this section is violated by any owner/operator who has obtained a permit hereunder, and said violation(s) is not rectified within a period of five (5) days from the date of receipt of written notification of the violation from the Mayor, the owner/operator’s permit shall be revoked. In addition to revocation of the permit issued hereunder, any said owner/operator violating the provisions of this chapter shall be subject to fine or penalty in the amount of $100.00 and not to exceed $500.00. This fine or penalty does not include any liabilities owner/operator may have to the Town for damage to Town property due to running, storing or parking of an said overweight/oversized vehicle on his or her private property or operating the same over any public street or other property belonging to the Town.
   (d)   The Mayor shall charge a fee not to exceed twenty-five dollars ($25.00) for the issuance of a permit under this section to pay the administrative costs thereof.
