7-2-1: COUNCIL AUTHORITY; BASEBALL AND SOFTBALL BOARD:
   A.   Rules And Regulations Enforced By Council: The city council shall promulgate, invoke, create, amend and enforce such rules, regulations and other requirements as it deems necessary or expedient in connection with fishing and fishing privileges, hunting and hunting privileges, boating and boating privileges, and swimming, and the use of all other recreational facilities owned or operated by the city. (See also section 1-10-4 of this code for park department.)
   B.   Baseball And Softball Board 1 :
      1.   Appointment: The city council is hereby directed and shall appoint a baseball and softball board for the city. The said board shall exercise all powers and duties imposed upon it by the laws of the state of Oklahoma and the ordinances of the city of Marlow.
      2.   Management Of Baseball And Softball Programs:
         a.   The baseball and softball board shall meet and by a majority vote adopt all needful rules and regulations governing and protecting the baseball and softball programs conducted on city owned facilities, including, but not limited to, all rules and regulations covering all baseball and softball organizations and governing the use of the baseball and softball fields by said organizations.
         b.   Said baseball and softball board shall have control of the day to day activities and scheduling of all baseball and softball programs using the baseball and softball fields owned by the city, and used for said purposes, including all practices, meetings and scheduled organized games and tournaments; and the board, where necessary, with the consent of the city, may appoint any employee or employees necessary for the proper control and management of said baseball and softball fields for use by any person or organization.
         c.   It is further provided that any and all rules and regulations, including any charges which shall be made for the use of any softball or baseball field or any other associated charges shall not become effective or may not be enforced by said baseball and softball board until said rules and regulations and any charges which shall be made shall have been approved by the city council, nor shall any employee be hired to assist with the administration of said baseball and softball board, or the care of any utilities used for said purpose, until the same has been approved by the city council or by the city administrator.
      3.   Special Meetings: The baseball and softball board shall hold such special meetings as may be required and the same shall be called in such manner as provided for by the statutes of the state of Oklahoma.
      4.   Disposition Of Funds:
         a.   Any charges, donations, deposits or bequests which may be made to the baseball and softball board shall be considered to be the funds of the city, and said board shall, after receiving any charges made for the use of any of the facilities, or after receiving any donations, deposits or bequests, surrender the same to the city treasurer and the city treasurer shall invest such funds in a manner required by law.
         b.   No expenditures shall be made to the facilities of the city without the city council first appropriating such funds and approving the expenditures made by the baseball and softball board. (1985 Code § 16-105)
