§ 111.13 GAME ROOM.
   (A)   This section shall be known as the “Marlinton Game Room Ordinance”.
   (B)   From and after the effective date of this section, it shall be unlawful for any person to operate or cause to be operated in the town a “game room” or “arcade” or any business which derives a substantial portion of its income from video games, pool games, pinball machines or other such machines, and caters primarily or substantially to minors, unless there is present at all times a responsible overseer or manager over the age of 21. No alcohol or drugs or any other substance forbidden to minors shall be permitted on the premises during business hours, and it shall be the affirmative duty of the manager and/or owner to ensure compliance with this provision. No minor shall be permitted outside the business building after the hour set by the Council for curfew. Any minor found outside the business shall be subject to being taken into protective custody until the minor is delivered into the custody of the parent or guardian of the minor. The manager and/or owner shall keep proper control of all persons in the business at all times and shall report all disturbances to the county jail or to the Police Department of the town. The requirements of this section are responsibilities of the owner or owners of the business, their managers, employees and agents, and all sanctions provided for in this section may be made against each one.
