§ 113.55 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   COIN-OPERATED AMUSEMENT DEVICES. Electronic games; amusement devices; pop machines; newspaper machines; cash stations; pay phones; and all types of vending machines whether or not they incorporate gaming or amusement features.
   ELECTRONIC GAMES and/or AMUSEMENT DEVICES. Any machine which, upon the insertion of a coin, slug, token, plate or disc may be operated by the public generally for use as a game, entertainment or amusement whether or not registering a score. It shall include, but not be limited to, such devices as jukeboxes, any form of electronic games played with electronically or electrically operated devices upon a table or board having holes, pockets, cups or electrically activated devices that are actuated by any object or electrical contacts, electrical impulse and/or cathode type games, and all games, operations or transactions similar thereto under whatever name by which they may be indicated. The term does not include vending machines in which are not incorporated gaming or amusement features, nor does the term include any coin-operated electronic or mechanical musical devices.
   OPERATOR. Any person, firm, LLC, corporation, partnership or association who or which sets up for operation by another or leases or distributes for the purpose of operation by another any device, as defined in this section.
   PERSON, FIRM, CORPORATION or ENTITY. Includes any person, firm, corporation or association which owns any electronic game or amusement device or any person, firm, corporation or association in whose place of business any such machine is placed for use by the public, or any person, firm, corporation or association having control over such machines.
   PREMISES. Any building, hall, auditorium or place where electronic games are kept and made available to the public for use.
   PROPRIETOR. Any person, firm, LLC, corporation, partnership or association who or which, as the owner, lessee or proprietor, has under his, her or its control any establishment, place or premises in or at which such device is placed or kept for use or play or exhibition for the purpose of use or play.
