§ 94.01 BURNING COMBUSTIBLE MATERIAL.
   (A)   Definitions. As used in this chapter.
      CHIMNEAS. Those outdoor fireplaces, usually made from clay, intended to confine and control outdoor wood fires.
      FIRE PITS. Outdoor fireplaces usually constructed of steel, concrete and/or stone and constructed above ground with a heavy steel screen cover.
      OUTDOOR FIREPLACES. Shall include fire pits, portable fire pits and chimneas. These residential outdoor fireplaces use wood as a fuel and are used for containing recreational fires located at a private residence for the purpose of outdoor cooking and personal enjoyment. Outdoor fireplaces do not include barbeque grills that use propane or charcoal as a fuel and are used primarily for outdoor cooking.
      PORTABLE FIRE PITS. Those outdoor fireplaces commercially designed and intended to confine and control outdoor wood fires.
   (B)   Outdoor fireplaces shall not be used within ten feet of any property line or structure.
   (C)   Outdoor fireplaces shall only burn untreated wood or approved fireplace starter logs, petroleum products, rubbish, grass, leaves, landscape waster, cardboard, plastics, construction debris or materials, rubber or any material that may flow out of the containment or cause excessive heat, smoke or offensive smell shall not be permitted.
   (D)   Notwithstanding any abatement costs that may be incurred by a person or entity pursuant to this chapter, any person violating any provision of this chapter shall be fined not less than $100 nor more than $750 for each offense. Every day that a violation exists constitutes a separate offense. Proceedings to enforce violations of this chapter may be initiated and conducted in accordance with and pursuant to the provisions of this code providing for administrative adjudication of code violations or by any other means provided by law.
