§ 123.03 REGULATIONS.
   (A)   It shall be unlawful for any hotel within the city:
      (1)   To permit any violation of any ordinance or law on or in hotel property.
      (2)   To rent any sleeping room by the hour or for any period of fewer than 12 consecutive hours.
      (3)   To rent any sleeping room more than once within any consecutive 12 hour period.
      (4)   To advertise an hourly rate or any other rate for a sleeping room for less than 12 hours.
      (5)   To permit prostitution, pimping, gambling or illegal possession or delivery of, or trafficking in, controlled substances, other drugs, or firearms to occur on or in the hotel or motel property.
      (6)   To fail to timely report to the police any criminal activity occurring on hotel property.
      (7)   To rent any sleeping room (or to advertise the renting thereof) for a period in excess of two consecutive weeks without first obtaining a specific "Extended Stay Hotel" license approval by the City Council.
   (B)   Upon application pursuant to § 151.46 of the Code of Markham, the City Council may grant approval for an "Extended Stay Hotel" as part of the hotel operator's license application and renewal and shall set specific parameters to the length of any permitted hotel stays in excess of two consecutive weeks. In no event shall the City Council approve an "Extended Stay Hotel" to provide accommodations in excess of six consecutive months without the operator first qualifying to lease residential rental property under the Code of Markham.
