(A) The sale or distribution by any person of a single or loose cigarette that is not contained within a sealed container, pack or package as provided by the manufacturer and bearing the federal health warning is prohibited.
(B) If any officer, director, manager, associate, member, representative, agent or employee of a licensed tobacco dealer is found guilty of violating this section, or if such violation occurs within the licensed premises and with the knowledge of any officer, director, manager, associate, member, representative, agent, or employee of a licensed tobacco dealer, such violation shall be deemed to be the act of the licensed tobacco dealer and shall be grounds for the suspension or revocation of the tobacco dealer’s license, as herein provided.
