Sec. 10-174. Application for license.
   An application for an itinerant merchant license must be obtained from the city zoning administrator two (2) weeks prior to the time of the sale. The application for license will be approved or disallowed by the zoning administrator after an investigation by the city police chief. The zoning administrator shall determine if the city zoning ordinance allows the sale of the goods, wares and merchandise to be sold in the proposed location(s). The itinerant merchant will be notified in writing if the application has been approved or disapproved. If the application is disapproved, the itinerant merchant will not be permitted to conduct business within the city limits of Marion. No application from an applicant previously convicted of a felony or misdemeanor involving fraud, forgery, sale of counterfeit goods, ticket scalping, violation of tax laws, or business license laws will be approved. No application will be approved that would involve the sale of goods, wares and merchandise in a location in violation of the city zoning ordinance. All approved itinerant merchant applicants will be required to submit a crew and vehicle registration form for purposes of information and identification. If the application is approved, the license fee set by city council and on file in the office of the tax collector must be paid prior to the issuance of the itinerant merchant license.
