(a) Upon receipt of an application, the city clerk shall cause to be made such investigation of the applicant's moral character and business responsibility as is necessary to protect the public health, safety and welfare.
(b) A criminal records background check is required for applicants for a license under this article, in order to protect the public health, safety and welfare. Such background check shall be conducted by the police department in conformity with state law. The result of the background check can determine the suitability of the applicant.
(c) If, as a result of this background check, the character and responsibility of the applicant appear to be satisfactory, the city clerk shall issue a permit, providing that the applicant complies with sections 10-112 and 10-113.
(d) The city clerk shall not issue a permit required by this article to any person who, as a result of the investigation and background check:
(1) Appears to have an unsatisfactory character and business responsibility; or
(2) As a result of the criminal background check, is deemed by the city clerk to be unfit to conduct the activities for which the license is applied.
