12-5-2: APPROVAL PROCEDURE:
   A.   Authority Of Code Enforcement Officer: The code enforcement officer is authorized to receive applications for large tract subdivisions, review said applications, and approve large tract subdivisions for recording.
   B.   Application For Subdivision; Fee: Applications for large tract subdivisions will be filed with the code enforcement officer on a prescribed form. The fee for said filing shall be twenty five dollars ($25.00). The application will include a legal description of the proposed subdivision with reference provisions to sections, townships and range. A scaled sketch of the proposed subdivision shall accompany the application that contains sufficient information for the code enforcement officer to determine: 1) that the smallest resulting parcel is ten (10) acres or more; 2) that no new easement of access will be required; 3) that no new street construction will be necessary; and 4) that the resulting subdivision will comply with the current provisions of title 11 of this code.
   C.   Review And Approval Of Application:
      1.   If the code enforcement officer determines it appropriate and necessary to the review of the application, the services of a registered civil engineer may be secured, at the expense of the subdivider, to assist in the verification of the standards stated above.
      2.   Upon determination of the application's compliance with the provisions of this title, the code enforcement officer may approve the application and authorize recording without further action by the city.
      3.   All review functions of the code enforcement officer pursuant to this chapter shall be conducted and concluded within thirty (30) calendar days of the date of the receipt of the application.
   D.   Request For Additional Information: Should the code enforcement officer determine that insufficient information exists to make a final decision on the application, a formal request for the additional information will be forwarded to the applicant. The review period may be extended an additional fifteen (15) calendar days upon request of additional information by the code enforcement officer.
   E.   Denial Of Application; Appeals: Incomplete applications and/or applications that fail to meet all of the qualifications for a large tract subdivision will be denied by the code enforcement officer. Applicants may appeal any decision of the code enforcement officer pursuant to this chapter to the city council. The city council will hear and decide the appeal at the next meeting.
