12-2-3: IMPROVEMENTS:
   A.   Permit Or Security Required For Streets And Sanitary Improvements: The subdivider, after approval of the application, may: 1) secure from the proper city authorities the necessary permits to proceed with the street and sanitary improvements, or, in lieu of this, 2) post with the commission a surety bond, or other security, in the form prescribed by the city council, sufficient to cover the full cost of improvements based upon estimates submitted to and approved by the code enforcement officer, unless waived by the city council.    B.   Inspection Of Improvements; Issuance Of Certificate: Upon the satisfactory installation of improvements in accordance with this title, the code enforcement officer will make a twofold certificate showing that the technical details of the plat itself have been checked and found satisfactory and all required improvements have been satisfactorily completed, or, in lieu thereof, a surety bond has been posted with the commission assuring their installation.    C.   City Council Approval: When the improvements have been certified as provided in subsection B of this section, or when a surety bond or other security has been provided or waived as so specified in subsection A of this section, the commission will transmit the plat to the city council for approval. Such plat shall bear an official notation reading:
Recommended for approval and acceptance this                  day of              . (Signed)                      Chair of the Plan Commission.
Thereupon, the city council may approve and accept the plat. (Ord. 1162, 7-14-1987; amd. 2013 Code)
   D.   Maintenance Bond Or Security Required: The subdivider shall post a maintenance bond or other security acceptable to the city council covering ten percent (10%) of the cost of any improvement to be accepted for maintenance by the city unless waived by the city council. Such bond shall be held by the city clerk and shall become effective upon acceptance of the plat by the city, unless otherwise stipulated. Maintenance bonds shall run for one year on such improvements. (Ord. 1162, 7-14-1987)
