10-4-1: ELECTRICAL CODE:
   A.   Adoption Of Code: The installation or alteration of any and all electric wiring, connections and apparatus, under the provisions of this title, shall be under the supervision of the Building and Codes officer and in accordance and in conformity with the rules and regulations set down in the rules and requirements of the National Board Of Fire Underwriters for electric wiring and apparatus as recommended by the National Fire Protection Association and known as the National Electrical Code of 2017, and same, by reference thereto, is adopted and approved as the specifications governing electrical conductors under this title; provided, that the fire chief and chief of police, respectively, shall have control of all matters pertaining to the installation and operation of the fire and police alarm system. At least one copy of the code herein adopted is on file in the Building and Code Services Department for public use and inspection. (1977 Code § 15.20.010)
   B.   Application To Heavy Industries: Any industry classified as "heavy industry" in the zoning ordinance which employs a graduate electrical engineer and which is equipped with fire extinguishing facilities that are operated by trained fire personnel shall comply, at its option, with one of the following alternatives:
      1.   Shall comply fully with the electrical code as incorporated herein; (1977 Code § 15.20.020)
      2.   At the start of construction of any permanent structure containing electrical wiring or equipment which is separated from the property of others by protective industrial steel fencing and which is more than fifty feet (50') from the property line of any other adjoining property which may be built upon by other individuals (for the purposes of this section the phrase "property which may be built upon" does not include any highway or railroad right of way, and provided further, in the case of two (2) adjoining properties occupied by like manufacturing, processing or storage structures, other than dikes, curbs, fences or retaining walls on each of the respective properties, shall be deemed to meet the clearance qualifications of the foregoing exception) may apply for an "exempt" permit, and the company shall submit a statement of such facts and the location within the city, whereupon the city shall ascertain such facts, and if correct, grant the applicant permission to proceed without complying with the types of construction and wiring designated by the electrical code. Upon completion of the structure, the applicant shall file a statement by a properly registered professional engineer, who may be one of the applicant's own employees, stating that he is familiar with the electrical work of said structure, and that same has been properly and soundly constructed. Such statement shall be accompanied with the fees provided by this title based on the estimated cost of construction. No such permit, statement or fee will be required for maintenance, repair, remodeling or minor additions to existing structures; provided, that the clearance, fencing and fire department requirements of the foregoing exception clauses are met.    C.   Penalty: Any person who shall violate any provision of this section shall, upon conviction thereof, be subject to a fine as provided in section 1-4-1 of this code. (amd. 2013 Code; Ord. 3836, 10-10-2022)
