A. Permit Required: No person, firm or corporation shall, within the corporate limits of the city, encumber or obstruct any public street, alley, or sidewalk in the city, or any part thereof, with building materials, vehicles, implements, boxes, or any article or thing whatever without first having obtained written permission from the mayor of the city. (1977 Code § 9.36.030)
B. Structures On Public Ways Prohibited: No person, firm or corporation shall make, erect, place or construct any structure, enclosure, fence, gate, stairway, or building encroaching, in whole or in part, upon any public street, alley, or sidewalk within the city. (1977 Code § 9.36.040)
C. Obstructing Sidewalks:
1. Prohibited Generally: No person or other entity shall place upon any city sidewalk any object that in any way obstructs the sidewalk.
2. Exemptions:
a. The prohibition mandated in subsection C1 of this section shall not apply to sidewalk sales conducted by an organized merchant group recognized by the city, provided such sales are limited to three (3) consecutive days on no more than three (3) separate occasions in each calendar year, and further provided, the items included in such sales are so placed as not to create or pose a hazard to the safety of the public or to prevent use of the sidewalk by the public.
b. The prohibition of subsection C1 of this section shall not apply to temporary barricades or other paraphernalia intended to warn or alert the public to a potentially hazardous condition. (Ord. 1743, 6-28-1999; amd. 2013 Code)
