8-1-3: REPAIR OR REPLACEMENT OF SIDEWALKS, CURBS AND DRIVEWAY ENTRANCES:
The street department may replace or repair sidewalks, curbs and driveway entrances upon the following conditions:
   A.   Request For City To Do Work:
      1.   Notice Of Replacement Or Repair: The owner of the real estate adjacent to the sidewalk, curb or driveway entrance shall notify the street superintendent of the desire to have such sidewalk, curb or driveway entrance replaced or repaired.
      2.   Estimate Of Costs: Upon being so notified, the street superintendent shall cause an estimate to be made of the cost of materials including, but not limited to, concrete, required to effect such replacement or repair. A copy of such estimate shall be given to the real estate owner.
      3.   Fee: Should such owner accept and agree to such estimate, a fee in the amount of fifty dollars ($50.00) will then be due and payable to the city in addition to the estimated cost of materials as aforementioned.
      4.   Records Kept: The street superintendent shall keep and maintain a list of those owners who desire replacement or repair of a sidewalk, curb or driveway entrance, the owner's names being kept in the order in which the fifty dollar ($50.00) fee and acceptance of such estimate is received.
   B.   Work Done By Owner: Anyone who desires to replace or repair a sidewalk, curb or driveway entrance without city assistance must receive approval by the street superintendent of the plan for replacement or repair, as proposed, as well as approval of the individual, firm or organization expected to make such replacement or repair.
   C.   Authority Of City To Repair Or Replace: The street superintendent may repair or replace a sidewalk, curb or driveway entrance at any time upon making a determination such repair or replacement is necessary to preserve and protect the public safety, anything herein contained to the contrary notwithstanding.
