It shall be unlawful for any person to ride a skateboard or bicycle in any area of the city designated herein as an area where skateboarding or bicycling is prohibited and/or operate a skateboard or bicycle in a negligent manner as provided herein.
A. Skateboarding and bicycling shall be prohibited in the city at the following areas:
1. City hall and city hall grounds including sidewalks, parking areas, driveways, stairs and rails, yards, and all areas associated with the city hall;
2. The Tower Square, including the tower area, its sidewalks, benches, rails and common area;
3. Municipal parking areas including sidewalks, parking areas, driveways, stairs and rails, yards, and all areas associated with the parking lots;
4. The Marion Carnegie Library including sidewalks, parking areas, driveways, stairs and rails, yards, and all areas associated with the parking lots;
5. The Pavilion of the city of Marion including sidewalks, parking areas, driveways, stairs and rails, yards, and all areas associated with the parking lots;
6. The Marion Cultural And Civic Center including sidewalks, parking areas, driveways, stairs and rails, yards, and all areas associated with the parking lots.
B. It shall be a violation of this chapter for any person to ride a skateboard or a bicycle in a negligent manner within the city.
C. In areas of the city where skateboarding or bicycling is not prohibited, it shall be a violation of this chapter for any person to ride a skateboard or bicycle in a manner contrary to traffic and/or pedestrian regulations.
D. It shall be a violation of this chapter for any skateboard or bicycle to be out of the direct physical control of the owner or user while it is in motion anywhere within the city. Any skateboard or bicycle in violation of this subsection is subject to seizure and forfeiture as provided in section 7-8-3 of this chapter. (Ord. 3172, 4-14-2014)
