7-7-7: NOISE CONTROL:
   A.   Muffler Required; Cutout Prohibited: No motor vehicle shall be operated on any street unless such vehicle is provided with a muffler in efficient actual working condition, and the use of a cutout is prohibited. (1977 Code § 10.44.100)
   B.   Unnecessary Noise Prohibited: It is unlawful to operate a vehicle which makes unusually loud or unnecessary noise. (1977 Code § 10.44.030)
   C.   Noise From Engine Braking System:
      1.   Definition: For the purpose of this subsection, "compression/release engine brake" is defined as any engine brake, compression brake, or mechanical exhaust device designed to aid in the braking or deceleration of any vehicle by converting engine power to compressed air which results in excessive, loud, or unusual noise from such vehicle, or otherwise known as jake braking.
      2.   Excessive Noise Prohibited: It shall be unlawful for the driver of any vehicle to operate or cause to be used any engine braking system that emits excessive noise, which shall include the use of engine compression brakes, also known as jake brakes, on any street, highway, or road within the city limits.
      3.   Exemptions For Emergencies: This subsection shall not apply if the driver used an engine braking system that emits excessive noise in an emergency to avoid a collision with a person or another vehicle.
      4.   Signs Posted: The street superintendent shall order and post signs at locations where streets enter the city which state: "Excessive Engine Braking Noise Prohibited". Such signs shall be erected and placed in accordance with rules adopted by the Illinois department of transportation. (Ord. 2165, 9-17-2007)
      5.   Penalty: The fine for violating the provisions of this subsection shall be not less than one hundred dollars ($100.00) nor more than seven hundred fifty dollars ($750.00). (Ord. 2165, 9-17-2007; amd. 2013 Code)
   D.   Sound Amplification Systems: No operator or person in possession of a motor vehicle within the city shall operate or permit the operation of any sound amplification system which can be heard outside the vehicle more than fifty feet (50') unless such system is being operated from an authorized emergency vehicle to warn of a situation hazardous to life, limb or property, or to request assistance in dealing with an emergency. Any violation of this subsection shall be a petty offense punishable by a fine as provided in section 1-4-1 of this code. (Ord. 1818, 9-24-2001; amd. 2013 Code)
