6-1-3: PREEMPLOYMENT CONTRACT:
   A.   Any applicant for a position in the fire department or the police department must agree to the following conditions at the time of making application for such position: that should he/she be hired as an employee of the city police or fire department, he/she will not voluntarily or involuntarily separate from the employ of the city for a minimum of thirty six (36) months from the date of hire, otherwise, he/she will remunerate the city for any and all costs incurred as enumerated in subsection B of this section at the following rate: One hundred percent (100%), if separation is prior to thirty six (36) months having elapsed from date of hire.
   B.   Schedule of costs which may be incurred by the city are: (Ord. 1744, 7-6-1999)
      1.   Any preentry medical examination required by the city police and firefighters' pension funds. (Ord. 1744, 7-6-1999; amd. 2013 Code)
      2.   Basic training, including Fire Fighter Recruit Academy and Police Training Institute Recruit Academy, including lodging, meals and travel expenses.
   C.   The obligations under the required agreement shall terminate after the completion of thirty six (36) months from the date of hire. (Ord. 1744, 7-6-1999)
   D.   The agreement shall contain a statement that the applicant understands that employment with the city is contingent upon his/her completion of a probationary period of twelve (12) months and continued performance to the satisfaction of the city. Nothing contained herein shall be construed as a promise or agreement by the city to retain the applicant as an employee of the city for thirty six (36) months or any portion thereof or thereafter.    E.   The city does not, by the agreement, waive any of the rights, privileges, or prerogatives it possesses now or hereafter in effect.
   F.   The applicant acknowledges that he/she has examined the agreement that he/she has read and understands the agreement, and he/she has the right to consult an attorney prior to entering the agreement. (Ord. 1744, 7-6-1999)
