5-3-2: EXEMPTIONS:
The following are generally exempted from the provisions of this chapter: Lands zoned agriculture as designated and shown on the official zoning map of the city unless used for nonagricultural purposes. For purpose of this section, "agricultural use" shall be construed to mean vacant land or the production of products such as field crops, livestock, fowl and other conventional agricultural pursuits. Provided, however, that the portions of those lands exempted by this section which are within forty feet (40') of the right of way of a public street or alley maintained for traffic or within forty feet (40') of the property line of adjacent lands used for nonagricultural or nonforestry purposes (for example, church, school, store, factory, house, apartment building, offices, etc.) shall not be exempted from the provisions of this chapter (Ord. 2206, 6-30-2008; amd. 2013 Code; Ord. 3909, - -2023)
