4-2-7: CLASSIFICATION OF LICENSES; FEES:
There shall be the following classes and subdivisions thereof:
   A.   Class I: Class I licenses may be issued to any qualifying person, entity, organization, and/or retail establishment as long as all qualifications for such license are met and complied with. Class I licenses shall authorize the retail sale of beer only and shall be five hundred dollars ($500.00), payable annually in advance. (Ord. 3393, 8-28-2017)
   B.   Class II:
      1.   Class II(a) licenses may be issued to any qualifying person, entity, organization, and/or retail establishment as long as all qualifications for such license are met and complied with. Class II(a) licenses shall authorize the retail sale of beer and wine only and shall be one thousand dollars ($1,000.00), payable annually in advance. (Ord. 3393, 8-28-2017; amd.       2.   Class II(b) licenses shall authorize the licensee, a governmental body or a contractor operating under the governmental body's direct supervision and control on the governmental body's premises to sell wine and beer at retail for consumption on the premises only. Any contractor of a governmental body applying for a Class II(b) license shall file a certified copy of its contract with its application for a liquor license annually and with each license renewal. The applicant for a Class II(b) license shall not be required to submit a nonrefundable deposit. (Ord. 3551, 8-12-2019)
   C.   Class III(a): Class III(a) licenses may be issued to any qualifying person, entity, organization, and/or retail establishment as long as all qualifications for such license are met and complied with. Class III(a) licenses shall authorize the retail sale, use, and consumption of alcoholic liquor of any kind on the premises, including at a restaurant, tavern, or bar, the fee for which shall be one thousand five hundred dollars ($1,500.00), payable annually in advance.
   D.   Class III(b): Class III(b) licenses shall only be issued to charitable organizations, or other similarly determined organization which are created and operated for charitable purposes, employ all their resources to those charitable activities that are under its direct control, and does not distribute any part of the income generated for the benefit of any trustee, trustor, member, or other private individual. Class III(b) licenses shall authorize the retail sale and consumption of any alcoholic liquor on the premises, the fee for which shall be one thousand dollars ($1,000.00), payable annually in advance.    E.   Class IV: Class IV licenses shall only be issued to motels, hotels, and/or any other business or premises used, maintained, advertised, and held out to the public to be a place where sleeping accommodations are offered for pay to travelers and guests, whether transient, permanent or residential, in which six (6) or more rooms are used for the sleeping accommodations of such guests, the fee for which shall be one thousand five hundred dollars ($1,500.00), payable annually in advance. Class IV licenses shall authorize the retail sale of all alcoholic beverages on the specified premises only of a motel, hotel and/or any other business or premises for consumption on the premises and also authorize the sale of beer and wine in their original package to registered guests and to no other persons, for consumption on the motel, hotel and/or any other business or premises only.    F.   Class V(a): Class V(a) licenses shall only be issued to package liquor stores in which the premises are used exclusively for the retail sale of alcoholic liquor in original package for consumption off the premises where it is sold. Class V(a) licenses shall be one thousand seven hundred fifty dollars ($1,750.00), payable annually in advance.
   G.   Class V(b): Class V(b) licenses shall be issued to package liquor stores for the retail sale of alcoholic liquor in the original package for consumption off the premises where it is sold, and also includes the sale of beer and wine by the drink for consumption on premises. Class V(b) licenses shall be two thousand dollars ($2,000.00), payable annually in advance.
   H.   Class VI: One Class VI license may be issued for operation of a microbrewery to brew no more than ten thousand (10,000) gallons of beer per year and to sell beer to be consumed on site or through carryout. The exterior appearance of the structure housing a microbrewery shall be compatible with that of other structures in proximity to the microbrewery. The fee for such license shall be one thousand five hundred dollars ($1,500.00), payable annually in advance. (Ord. 3393, 8-28-2017)
   I.   Class VII: An establishment that is in possession of an existing license, may upon the approval of the Liquor Control Commissioner, receive an additional license as defined in this section for the same location. The fee for such license shall be five hundred dollars ($500.00), payable annually in advance. Sunday sales of alcoholic beverages by holders of a Class VII license are prohibited unless the holder, thereof, has a Class III(a) license.
   J.   Class VIII - licenses may be issued to any qualifying caterer or transient organization as long as all qualification for such license are met and complied with. Class VIII - license shall permit the sale of alcohol beverages to be consumed on premises at the catering location. The catering location is defined as a location which is not open to the general public where, pursuant to an agreement with an event sponsor, the licensee is providing prepared food for serving at private events, such as wedding receptions or other similar events. If the Class VIII licensee has entered into a contract with another individual or entity for the service of food at the catered event, the copy of the contract shall be available for inspection on the premises of the catered event during the event. No event catered by a Class VIII licensee shall exceed seventy-two (72) hours in length, nor shall alcoholic liquor be served at any catered event for more than eight (8) consecutive hours. The fee for a Class VIII license shall be one thousand five hundred dollars ($1,500), payable annually in advance. The fee would be seven hundred fifty dollars ($750) for an existing license holder who is adding a Class VIII license. (Ord. 3401, 8-31-2017; amd. Ord. 3671, 11-9-2020)
