If the Building Enforcement Board so prescribes, no unfit nonresidential dwelling, building or portion thereof shall be occupied or used for any purpose after the service of notice upon the owner or owners, as provided in Section 1335.04, until the instructions of the Board have been complied with, rescinded or set aside. However, any owner shall have the right to apply to the Washington County Common Pleas Court for a temporary injunction restraining the Board pending final disposition of the case.
