927.09 WATER SERVICE TO PREMISES OUTSIDE THE CITY.
   No water service shall be extended to any premises located outside the corporate limits of the City of Marietta, Ohio, except upon the terms and conditions set forth herein:
   (a)   Premises Contiguous to Corporate Limits of the City of Marietta, Ohio.
      (1)   The City of Marietta, Ohio may extend water service to premises located outside the corporate limits of the City upon the occurrence of the following:
         A.   Passage of a resolution by Council specifying the premises to be served, the category of use of the premises [Industrial; Commercial; Residential] and size of the tap for said premises;
         B.   Owner of the Premises bears the cost of installation and extension of said service, including, but not limited to, all tap and permit fees under Section 927.09, or as otherwise provided.
         C.   Owner of premises abides by all other specifications, terms, and conditions promulgated by the Director of Public Safety and Service.
      (2)   Execution by the Owner of the premises of an Agreement for Water Service, providing for the annexation of the premises in question to the City, and requiring such Owner to exert all efforts to obtain annexation of said premises to the City, including, if requested by the City, signing an annexation petition, and further obligating said Owner to impose a requirement by deed covenant, or restriction, that subsequent Owners of said premises, or any portion thereof, also execute an Agreement for Water Service with the City.
      (3)   Owners of any premises located outside the City and presently receiving water service from the City, shall, upon 120 days written notice from the City, comply with the terms and conditions set forth herein. Failure to comply with said terms and conditions shall result in the termination of said water service upon the expiration of the notice period.
   (b)   Premises NOT Contiguous to Corporate Limits of the City of Marietta, Ohio.
      (1)   No water service shall be extended to any premises located outside the corporate limits of the City, but NOT contiguous thereto, except upon the passage of a resolution granting a tap for such service and upon the payment of a cash deposit to the City, by the Owner of the premises to be served in the following amounts, as appropriate based upon their actual or intended use:
         A.   Industrial         $5,000.00
         B.   Commercial         $4,000.00
         C.   Residential         $3,000.00
      (2)   The resolutions called for herein to grant taps for water service to such premises, shall specify the category of use of the premises in question [Industrial; Commercial; Residential] and the size of the tap, and shall provide that the Owners of the premises bear the entire cost of the installation and extension of such service, including tap and permit fees as applicable, and shall act in accordance with the specifications, terms, and conditions promulgated by the Director of Public Safety and Service.
