§ 31.079 VILLAGE ENGINEER.
   (A)   There is created the position of Village Engineer, to be filled by appointment of a suitable person who shall be a registered professional engineer, licensed to practice in the state, and shall have experience in the design and construction of public works and municipal facilities.
   (B)   The Village Engineer shall, on request, attend meetings of Council or meetings of any committees thereof for consultation and advice. At the request of the Mayor, Building Commissioner, or Council, he or she shall make a cursory examination and report of the condition of any streets, sidewalks, buildings, or any other property owned by or under the control of the village; make recommendations as to necessary or desirable tests, explorations, surveys, repairs, or replacements. It is anticipated that work under this division (B) will require an average of five hours per month for the entire year. For the aforementioned services the compensation range shall be established from time to time by Council.
   (C)   In addition to the compensation mentioned in division (B) above, the Village Engineer shall be paid for the performance of all additional duties including, but not limited to, those described below; and compensation shall also be paid to firms or individuals assisting the Village Engineer with his or her services as described below.
   (D)   When directed by the Council, the Village Engineer shall select projects or streets for public works projects based on budget recommendations from Council committees; prepare reports or studies other than described under division (B) above; direct or assist in consultant selection process; direct consultant services; prepare plans and specifications, detailed cost estimates, review bids; recommend awarding public works contracts; review plans or reports prepared by others; prepare line and grade surveys, construction management for street, sidewalk, utility and other public works projects; prepare funding applications; represent the village in meetings or correspond with city, county, and state officials or citizen groups; and assist in preparing agreements. The Village Engineer shall be compensated as established by Council from time to time.
   (E)   The Mayor shall, upon the recommendation of the Village Engineer, appoint necessary assistants and fix the amount of their compensation at such times as the services of assistants appear to be necessary or advisable.
   (F)   The Village Engineer may serve as an agent of the village in the selection and procurement of technical engineering services as required on a per project basis, subject to the approval of Council prior to the performance of such services.
   (G)   In the event of a conflict between the interests of the village and those of other employers of the Village Engineer, with respect to any village work requiring engineering or surveying services, the Council may employ an engineer or surveyor other than the Village Engineer to perform such services.
