In all cases in which the construction, repair, or alteration of any building or other structure will require an excavation within three feet of the curb line of any street, permits must be obtained from the Building Commissioner before excavation is commenced. Such permits shall be similar to those issued for street openings and applications therefor must be accompanied by deposits based on the estimated cost of restoring the street openings. In cases where the edge of the excavation is more than three feet from the curb line, the Building Commissioner shall, at the first indication of any settlement in the street surface or curbing, require the builder to obtain a street opening permit from the Department and shall have the right to suspend or cancel the building permit until the street opening permit has been issued.
