1494.04 ISSUANCE; REVOCATION.
   (a)   Issuance of Certificate of Occupancy. If it is found that a building is in compliance with the Ohio Building Code, the Property Maintenance Code and all other laws applicable thereto, the Building Commissioner shall issue a certificate of occupancy for such building or use. which shall contain information as established by Department policy, State law and the adopted Ohio Building Code(s).
   (b)   Denial of Certificate of Occupancy. Should the Building Commissioner find that said building(s), structure(s) or property to be deemed unsafe and therefore unfit for occupancy, the Building Commissioner may, at his or her discretion, issue a "Temporary Transfer of Title only Occupancy Permit", which will set the date for which the building(s), structure(s) or property shall be free of all life safety violations of the Ohio Building Code(s) or the Property Maintenance Code.
   (c)   Expiration of Certificate of Occupancy. A certificate of occupancy shall be valid until a change of the owner of record, or the change of use as defined in the Ohio Building Code takes place, for an owner-occupied single-family, two-family, and three-family dwellings, and non-owner occupied single-family, two-family and three-family dwellings, multi-family dwelling buildings (three or more units), nonresidential buildings and nonresidential tenant spaces.
   (d)   Revocation of Certificate of Occupancy. The Building Commissioner may revoke a certificate of occupancy if any false statement is made by the applicant in connection with the issuance of such certificate, or for noncompliance of the Building Code(s) or if the owner, agent or person in charge of a building refuses to comply with the Ohio Building Code.
   (e)   Notwithstanding any other provisions of this chapter, no certificate of occupancy shall be issued by the Building Commissioner for any structure used or intended to be used for residential occupancy located on a parcel which:
      (1)   Has a certified delinquent property tax balance or other unpaid liens that appear on the Cuyahoga County Real Property Tax duplicate unless the property owner, agent, or person in charge of such structure provides documentation of being on a delinquent payment plan in good standing with the Cuyahoga County Treasury; or
      (2)   Has an unpaid balance for nuisance abatement costs imposed by the City pursuant to Codified Ordinances Sections 680.05(c), 680.06(d), 680.07(c) or 680.10(d) that has not been placed on the Cuyahoga County Real Property Tax duplicate.
   If such structure as described above is determined by the Building Commissioner to be occupied by a tenant, the Building Commissioner shall provide notice to such tenant of the rejection of application for the issuance or renewal of a certificate of occupancy. Notice shall be by mail, hand delivery, or posting on the structure. Notwithstanding the requirement of notice provided herein, failure of the Building Commissioner to notify a tenant shall not preclude the enforcement of any provision of this chapter.
