(a) Information Required. The owner of a structure, tenant space, or use requiring a certificate of occupancy shall apply for such certificate prior to any occupancy or transfer of title. Failure to timely apply will be deemed to be a violation of the Ohio Building Code.
(1) An application shall be filed with the Building Commissioner to provide the information and data required to determine compliance with the Ohio Building Code, applicable laws, ordinances, rules and regulations for the existing or intended use of the building or property, on forms supplied by the Building Commissioner.
(2) The property owner or his or her agent shall supply the information required on an application for certificate of occupancy provided by the Building Commissioner, two weeks prior to the desired date of inspection. The Building Commissioner shall require the submission of an affidavit stating such information.
(3) If the owner of record of any property is not a resident of Cuyahoga County, such owner of record shall designate and file with the Building Commissioner a photo identification showing the name, address and telephone number, and date of birth of an agent or person in charge who is a resident of Cuyahoga County for the purpose of accepting all notices of inspection and/or violations and other communications from the City concerning that property. Notice given to such agent or person in charge shall be deemed notice given to the owner.
(4) The owner of a structure, tenant space or use shall notify all prospective tenants, in writing, of the requirement for each new tenant to have a certificate of rental compliance issued according to Chapter 1487 of the Codified Ordinances.
(b) Property Inspection Required. The Building Commissioner shall require a general interior/exterior inspection of all occupied and appurtenant structures, and exterior property areas to verify compliance with the Property Maintenance Code, and the Ohio Building Code(s) prior to the issuance of any certificate of occupancy or approval to allow transfer of title.
(c) Inspection Report; Validity. The Ohio Building Code inspection report, the point of sale inspection report, and the Property Maintenance Code inspection report shall be valid for six months from the issuance date of the violation(s) notice. However, in the event said property does not have change of occupant, occupancy, and/or use, or transfer of ownership does not occur within six months from the date of application filing, the owner, or property manager shall be required to correct all violations contained in the point of sale/property maintenance inspection within six months of the date of the point of sale/property maintenance inspection notice.
