1225.17 PENALTY.
   (a)   Whoever violates any of the provisions of this chapter is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
   (b)   The imposition of any other penalties provided herein shall not preclude the City of Maple Heights instituting an appropriate action or proceeding in a court of proper jurisdiction to prevent an unlawful development, or to restrain, correct, or abate a violation, or to require compliance with the provisions of this regulation or other applicable laws, ordinances, rules, or regulations, or the orders of the City of Maple Heights.
   (c)   All expenses incurred by the City of Maple Heights to initiate an enforcement action, implement a mitigating event, remediation of damages caused or resolve a violation shall be the responsibility of the applicant shall be deducted from any funds or bonds on file with the Finance Department.
