Where, as a result of improper implementation of approved BMPs, soil, rock or debris has washed down into a sewer, stream or pond from its place of origin due to construction activities, the owner and/or the development and/or the contractor(s) causing or permitting such erosion and wash down of soil, rock or debris shall immediately, upon written notice form the City Engineer or the Law Director, enter upon or into such sewer, stream, pond or lake and remove all such soil, rock or debris in a manner approved by the City Engineer and shall restore such sewer, stream, pond or lake to its condition prior to the beginning of the erosion or wash down of the soil, rock or debris.
