(a) The City has heretofore installed a system of sewerage for public use; such system is interconnected to the sewerage treatment and disposal system of the Northeast Ohio Regional Sewer District; and the District is responsible for the treatment and disposal of all wastewater emanating from the City and transported through the interconnected system of sewerage to such District's treatment and disposal facilities. Council finds that the District has set rates for the treatment and disposal of wastewater based upon 1,000 cubic feet (MCF) of water used and that such rates are just and equitable for the treatment and disposal of wastewater emanating from the City. Council further finds that the rate of nine dollars ($9.00) per MCF is a just and equitable sewer use rate and is hereby established and shall be charged to the residents of the City for the replacement and repair of storm and/or sanitary sewers of the City. Such rate shall be charged in addition to the treatment and disposal rate set forth by the Northeast Ohio Regional Sewer District.
(b) Use of the nine dollar ($9.00) surcharge provided for in division (a) of this section shall be deposited in the Water Usage Fund, #219. Use of the nine dollar ($9.00) surcharge and the Water Usage Fund is hereby authorized for any purchase deemed necessary by the City, and approved by City Council, for the improvement of the City's sewerage system and related problems only, which may include engineering, legal, testing and appurtenance costs where the same are deemed necessary by the City, and approved by City Council for the improvement of the City's sewerage system.
(c) The Northeast Ohio Regional Sewer District has entered into an agreement with the City of Cleveland whereby its sewerage treatment and disposal rates are billed and collected by the City of Cleveland as part of its water billing system. The District is hereby authorized to cause its treatment and disposal rate and the sewer use rate herein established to be billed and collected directly from the residents of the City of Maple Heights pursuant to such agreement and to cause the revenue derived from the sewer use rate of nine dollars ($9.00) per MCF established in division (a) of this section to be distributed to the Director of Finance/Auditor for use in accordance with this section.

(d) The revenues derived from the sewer use rate herein established shall be placed in a separate fund and expended for the purposes authorized by law and for no other purposes. The Director of Finance/Auditor is hereby charged with the enforcement of this section and shall give a yearly report on such separate fund. The Engineer shall give a yearly review on the status of the intent of this chapter.
(e) At the time of the passage of this subsection, there is no charge to the City for the billing herein provided for through the Northeast Ohio Regional Sewer District. However, should a subsequent billing charge be invoked against the City, the District and the City of Cleveland are hereby authorized and directed to include such billing charge in each bill to City of Maple Heights users as part of the charge for the first 1,000 cubic feet (MCF) of water used.
