Before any certificate of occupancy is issued, pursuant to Section 1262.07 of the Planning and Zoning Code, the proper tree must be planted in the tree lawn by the owner or developer, unless an approved tree is already planted and growing in the tree lawn. If, due to weather or planting conditions, the tree cannot be planted prior to the time of occupancy, the developer or owner must deposit the sum of fifty dollars ($50.00) per tree with the Director of Service until the tree is planted, in order to obtain a certificate of occupancy. If the tree is not planted within one year of occupancy, the Director may use such deposit to install the necessary tree.
