Any person desiring to make any opening or other excavation in any street or public place within the City shall make an application in writing to the Director of Service for the issuance of a permit therefor. Such application shall specify the location and object of such street opening or excavation, together with an agreement to save the City harmless from any and all cost, expense or liability arising or in any manner resulting from the making of such opening or excavation. If the Director finds that the applicant is authorized to make such opening or excavation, and is of the opinion that the permit should be issued, he or she shall issue such permit; otherwise he or she shall report the application to Council at the next meeting, and the decision of Council shall be final.
