856.10 INSPECTION OF HOMES; FIRE PREVENTION PERMITS; CORRECTION OF VIOLATIONS.
   (a)   It shall be the duty of the Mayor's office to inspect nursing homes for which licenses have been issued hereunder as often as necessary for the adequate control and supervision of the same, and the Mayor's office shall have the right to enter all such homes at any reasonable time for the purpose of making necessary investigations and inspections and shall be charged with the responsibility of enforcing and administering the provisions of this chapter. Every nursing home shall at all reasonable times be open for inspection by the Fire Marshal and the Building Department of the City as well as the Mayor's office.
   (b)   A fire prevention permit shall be issued annually. This permit shall be issued after a thorough inspection has been conducted and the premises are reasonably safe from fire and other hazards. Any violations noted during such inspection shall be corrected within the allotted time specified, as provided in Ohio R.C. 3737.42.
   (c)   In case of any failure by a licensee to comply with the requirements of this chapter or any rules and regulations promulgated pursuant hereto, the Mayor or his or her designee shall notify the licensee to correct the noncompliance, breach, default or illegal condition within such number of days as is reasonable in the light of the conditions to be remedied. In the event of failure, or upon refusal of the licensee, to comply with the Health Department's instructions, the Mayor shall revoke the license. However, upon a showing of hardship or other circumstances warranting such action, the Mayor shall have the authority to grant an extension of time for compliance with the Mayor's instructions.
