850.03 PINBALL MACHINES AND MECHANICAL OR ELECTRONIC DEVICES; PERMIT APPLICATION; FEE; TRANSFERS; DISPLAY; ADULT MANAGEMENT.
   (a)   No person, or business being the owner, operator or possessor of a pinball machine or mechanical or electronic amusement device, or other similar or related device, shall display for public patronage or keep for operation of the public any such device without first obtaining a permit therefor from the Building Commissioner.
   (b)   Application for a permit required by subsection (a) hereof shall be made on a form furnished by the Building Commissioner. Such application shall contain the following information and such other and further information that may be requested by the Mayor: Building Commissioner:
      (1)   The name, address, age and date of birth of the applicant;
      (2)   The place and address where the device(s) will to be located;
      (3)   A description of the device(s), including the manufacturers listing and labeling information, installation instructions and the serial number(s) for the devise(s);
      (4)   The owner(s) name, address, age and date of birth different from the applicant;
      (5)   If the applicant is a partnership or corporation, the application shall include the name, address, age and date of birth of the owner(s), or principals of the partnership or the officers and shareholders of the corporation; and
      (6)   A statement as to whether or not the applicant, the owner of the device(s), any principal of the partnership owning the same, or any officer or shareholder of the corporation owning the same, has ever been convicted of a felony or of any gambling offense, whether a felony or a misdemeanor.
   (c)   Each person to whom a permit is issued pursuant to this section shall pay an annual permit fee of two hundred dollars ($200.00) for each device for which a permit is required.
      (1)   Failure by an owner, agent, or tenant, to comply with any provision of this chapter by installing any devices as described in Section 850.01 without a permit, or who fails to renew the permit annually on or before December 31 , shall be subject to the permit fees being tripled.
   (d)   No permit provided for herein shall be transferred from the permit holder to any other person, corporation or business and or from one location to another location, without the prior written consent by the Building Commissioner.
   (e)   Each permit holder shall cause to be prominently displayed in the premises where the device is located a sign stating "Gambling is Prohibited and City Ordinances Enforced."
   (f)   Each permit holder shall, at all times during the hours of operation, provide adult management of any premises where a device is located.
