No permit to conduct a massage and/or bath establishment, or to engage in the business of, or to be employed as, a massage technician, shall be issued, renewed or continued unless each of the following provisions is complied with by the massage and/or bath establishment and/or the massage technician:
(a) No massage technician or employee shall administer a massage unless he or she is completely clothed in clean nontransparent garments at all times. The term "completely clothed" means having on the upper portion of the body undergarments and either a blouse or a shirt which covers all the upper body except the arms, and having on the lower body undergarments plus either pants, shorts or a skirt.
(b) The massage patron's private parts shall be covered with a towel, cloth or undergarments when in the presence of a massage technician or a massage and/or bath establishment employee.
(c) A massage technician and massage and/or bath establishment shall display his or her or its permit in a conspicuous place where the massage is being administered.
(d) A massage technician shall not administer a massage to an individual of the opposite sex unless requested by a massage patron.
(e) The massage and/or bath establishment facilities shall be subject to inspection by law enforcement officers, health inspectors or building inspectors during working or operating hours to ensure compliance with this chapter.
(f) A massage technician shall not fondle, touch or massage the sexual or genital area of any patron.
(g) A massage and/or bath establishment operator shall provide the Mayor's office with the names of all employees and massage technicians working for the establishment within two days of the date that the individual is employed.
(h) No massage technician or massage establishment operator shall knowingly violate any of the provisions of this chapter.
