826.23 NURSE QUALIFICATIONS; ANCILLARY PERSONNEL
   (a)   Nursing care in a facility shall be under the direction of a currently registered professional nurse who possesses additional qualifications, acquired by training and experience, which are essential to the proper and safe conduct of the surgical procedure undertaken and nursing care attention to the postoperative observation and needs of patients.
   (b)   A registered professional nurse shall be on duty. Such nurse shall possess the special skills and experience necessary to supply or supervise all nursing care needs of patients in preparation for and during the surgical procedure and the recovery period until discharge by the responsible physician.
   (c)   A licensed practical nurse with special training and experience working under appropriate supervision and direction may be used to complement the registered professional nursing staff to perform duties within the scope of his or her competence and the restrictions of the nursing practice act.
   (d)   Ancillary personnel participating in patient care who are adequately trained and working under appropriate direction or supervision may be employed to assist within the areas of their competence in the conduct of the work of the facility.
