(a) Civil Penalties. If it is found that the grantee has violated any of the provisions of this chapter, the grantee shall be penalized as follows, in addition to and separate from the criminal penalties set forth in a subsection (b) hereof:
(1) For failure to complete construction and installation of the cable television system or to provide service in accordance with this chapter and the grantee's application as incorporated herein, unless Council specifically approves the delay by resolution because of good cause shown by the grantee, the grantee shall forfeit five hundred dollars ($500.00) per day or pat thereof that the violation continues.
(2) For failure to provide or maintain data and reports as requested by the City or as required herein, the grantee shall forfeit one hundred dollars ($100.00) per day or part thereof that the violation continues.
(3) For failure to comply with the operational standards following Council's resolution directing the grantee to make improvements pursuant hereto, the grantee shall forfeit two hundred dollars pursuant hereto, the grantee shall forfeit two hundred dollars ($200.00) per day or part thereof that the violation continues.
(4) For failure to test, analyze and report on the performance of the system following the reasonable request of the City pursuant hereto, the grantee shall forfeit one hundred dollars ($100.00) per day or part thereof that the violation continues.
(5) For failure to pay the franchise fee when due pursuant to this chapter, the grantee shall forfeit one hundred dollars ($100.00) per day or part there of that the violation continues.
(6) For failure to comply with any other material term or condition of this chapter, the grantee shall forfeit one hundred dollars ($100.00) per day or part thereof that the violation continues.
(7) For persistent failure to comply with such reasonable requests and recommendations as may be made by the City pursuant to authority granted by this chapter, the grantee shall forfeit one hundred dollars ($100.00) per day or part thereof that the violation continues.
The rights and penalties contained in this subsection are separate, distinct and in addition to those enumerated elsewhere in this chapter, particularly the criminal penalties set forth in subsection (b) hereof.
(b) Criminal Penalties.
(1) Whoever violates or fails to comply with any of the provisions of this chapter, for which no penalty is otherwise provided, is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
(2) Any grantee violating Section 816.35(c) or (e) shall be fined not more than ten thousand dollars ($10,000) for each offense.
