660.22 TRIMMING OF TREES, HEDGES OR GROWTH ADJACENT TO PUBLIC WAYS.
   (a)   The owner of every lot or parcel of land within the Municipality upon which a tree, plant, hedge or shrubbery stands shall maintain such growth so as to provide a clear and unobstructed view of traffic and pedestrians from all directions from any adjoining streets, driveways or parking areas. Such property owner shall also abate any nuisance necessary to protect life, limb or property of persons, drivers of any vehicles or pedestrians using adjacent sidewalks, streets, driveways or parking areas.
   (b)   A written notice of the existence of a nuisance under this section from any law enforcement officer from the Police Division of the City shall constitute prima-facie evidence of the existence of such a nuisance, and the property owner shall abate such nuisance within seventy-two hours of such notice being delivered or posted upon such property.
   (c)   Whoever violates this section is guilty of a misdemeanor of the first degree and shall be subject to the penalty provided in Section 698.02. Further, and in addition to such penalty, the City may cause any such tree, shrub, hedge or growth to be trimmed or cut down so as to eliminate the hazard or abate the nuisance, and may assess the cost thereof against the owner of such lot or parcel of land.
