260.04 HOLIDAYS.
   (a)   Effective August 1, 2000, full-time employees of all City departments, excluding all employees covered by collective bargaining agreements, shall be entitled to thirteen paid holidays annually, as follows:
 
New Year's Day
Labor Day
President's Day
Thanksgiving Day
Martin Luther King Birthday
Christmas Day
Good Friday
Employee's birthday - floating
Memorial Day
Election day - floating
June paid holiday
Veterans Day - floating
Independence Day
 
   The pay due for a holiday will be equivalent to a working day's pay.
   (b)   City offices will be open on the General Election Day and on Veterans' Day holidays. Employees may continue to observe these holidays by using them as floating holidays.
   (c)   The June paid holiday shall be a day's pay, paid with the first pay in June annually. At the employee's option, he or she may take one additional day off in lieu of the day's pay. The day to be taken shall be at the discretion of the employee, subject to prior approval from his or her supervisor. To be eligible for the June paid holiday, an employee must be employed by the City on June 1.
   (d)   The floating holiday shall be taken at the employee's discretion, subject to prior approval from his supervisor, provided that minimum staffing levels are maintained.

   (e)   School guards shall receive five paid holidays after one year of service as follows:
      Thanksgiving Day
      Christmas Day
      New Year's Day
      Memorial Day
      Labor Day
   For summer school sessions, school guards shall receive one paid holiday as follows:
      Independence Day
   Holiday pay shall equal a normal working day's pay.
   (f)   When a holiday observed falls on the first day of a weekend, the holiday will be celebrated on the day preceding the weekend. When a holiday falls on the second day of a weekend, the holiday will be celebrated on the day succeeding the weekend.
   (g)   If a holiday occurs while an employee is on vacation leave, such day shall not be charged against vacation leave.
   (h)   If a 40 hour employee is required to work on a holiday, he or she shall be paid at the rate of time and one-half for all hours worked plus his or her regular holiday pay. This provision shall not apply if the employee is given an alternate day off during that calendar week. This provision also does not apply to police, fire and administrative personnel.
   (i)   For an employee to receive holiday pay, he or she must work the complete scheduled day preceding and the complete scheduled day succeeding the holiday. If an employee fails to work as prescribed herein, he or she shall forfeit his or her right to the holiday and shall be paid as though on sick leave if he or she has sufficient earned sick leave credit. Before an employee can be paid sick leave under this provision, he or she must present a doctor's statement to his or her department head, documenting his or her illness.
   (j)   Employees who are on the City payroll June 1 of each calendar year shall be eligible to earn the June paid holiday. Employees who have worked six full calendar months of each calendar year shall be eligible to earn the floating holiday of each calendar year. Employees who do not work the entire 12 months of the calendar year will not be entitled to receive both the June paid holiday and the floating holiday for that calendar year.
