244.01 DIVISIONS OF POLICE AND FIRE; COMPOSITION AND DUTIES.
   The Divisions of Police and Fire of the Department of Safety shall be composed of the following officers and other employees as herein provided, whose salaries shall be payable biweekly from the proper fund:
   (a)   Chief of Police. There shall be one Chief of the Division of Police, appointed by the Director of Safety after certification by the Civil Service Commission of the City in accordance with its rules and regulations and in further compliance with the civil service statutes of the State, as the executive head of the Police Division. The Chiefs duties shall be such as are usually and ordinarily performed by the Chief of Police of municipalities as prescribed by law, or such as are prescribed in the rules and regulations of the Director of Safety.

   (b)   Captains of Police. There shall be any number up to two (2) Captains of the Division of Police, appointed by the Director of Safety after certification by the Civil Service Commission of the City in accordance with its rules and regulations and in further compliance with the civil service statutes of the State. The Captain's duties shall be provided by law, by the rules and regulations prescribed by the Director of Safety and as may be required by the Chief of the Division of Police.

   (c)   Lieutenants of Police. There shall be any number up to four (4) Lieutenants of the Division of Police, appointed by the Director of Safety after certification by the Civil Service Commission of the City in accordance with its rules and regulations and in further compliance with the civil service statutes of the State. The Lieutenant's duties shall be provided by law, by the rules and regulations prescribed by the Director of Safety and as may be required by the Chief of the Division of Police.

   (d)   Sergeants of Police. There shall be any number up to five Sergeants of the Division of Police, appointed by the Director of Safety after certification by the Civil Service Commission of the City in accordance with its rules and regulations and in further compliance with the civil service statutes of the State. The Sergeant's duties shall be provided by law, by the rules and regulations prescribed by the Director of Safety and as may be required by the Chief of the Division of Police.

   (d)   (1)    Jail Administrator. There shall be one Jail Administrator of the Division of Police, appointed by the Director of Safety and to serve at the pleasure of the Director. The Jail Administrator shall be responsible for the day to day management of the City Jail.

   (e)   Other Police Division Personnel. The rest of the Division of Police, consisting of up to forty-five police officers, shall be classified as follows:
      (1)   Cadet police officers, who shall be appointed by the Director of Safety after certification by the Civil Service Commission of the City in accordance with its rules and regulations and in further compliance with the civil service statutes of the State. Cadet police officers shall serve a probationary period of eighteen months, satisfactory to the Director of Safety, and their duties shall be as provided by law, by the rules and regulations prescribed by the Director of Safety and as may be required by the Chief of the Division of Police.
      (2)   Cadet First Class officers, who shall be police officers with more than eighteen months, but less than two years, of service. Their duties shall be as provided by law, by the rules and regulations prescribed by the Director of Safety and as may be required by the Chief of the Division of Police.

      (3)   Patrolmen First Class, with two years or more of service, whose duties shall be as provided by law, by the rules and regulations prescribed by the Director of Safety, and as may be required by the Chief of the Division of Police.

   (f)   Detective Bureau. There is hereby established a Detective Bureau in the Division of Police. Such Bureau shall consist of up to ten regular members of the Division of Police, up to two members of which shall perform full-time duty of Juvenile Officers, until such time as the number is increased by new legislation. The transfer of police personnel to the Detective Bureau shall be made by the Chief of the Division of Police, based on a meritorious evaluation. Such personnel are deemed transferred only to the extent that they shall perform their duties in civilian dress. Such personnel transferred to the Detective Bureau subsequent to March 1, 1972, shall have, following their attained rank, the designation Detective II.

   (g)   Women's Bureau. (EDITOR'S NOTE: Subsection (g) was repealed by Ordinance 1996-113, passed November 6, 1996.)
   (h)   Fire Chief. There shall be one Chief of the Division of Fire, appointed by the Director of Safety after certification of the Civil Service Commission of the City in accordance with its rules and regulations and in further compliance with the civil service statutes of the State. The Chiefs duties shall be that of the Chief of the Division of Fire, as prescribed by law and by the rules and regulations prescribed by the Director of Safety.

   (i)   Captains of Fire. There shall be any number up to four Captains of the Division of Fire, appointed by the Director of Safety after certification by the Civil Service Commission of the City in accordance with its rules and regulations and in further compliance with the civil service statutes of the State. The Captain's duties shall be provided by law, by the rules and regulations prescribed by the Director of Safety and as may be required by the Chief of the Division of Fire.
   (j)   Lieutenants of Fire. There shall be any number up to six Lieutenants of the Division of Fire, appointed by the Director of Safety after certification by the Civil Service Commission of the City in accordance with its rules and regulations and in further compliance with the civil service statutes of the State. The Lieutenant's duties shall be provided by law, by the rules and regulations prescribed by the Director of Safety and as may be required by the Chief of the Division of Fire.

   (k)   Other Fire Division Personnel. The rest of the Division of Fire, consisting of up to forty fire- fighters, shall be classified as follows:
      (1)   Fire Cadet officers, who shall be appointed by the Director of Safety after certification by the Civil Service Commission of the City in accordance with its rules and regulations and in further compliance with the civil service statutes of the State. Fire Cadet officers shall serve a probationary period of eighteen months, satisfactory to the Director of Safety, and their duties shall be as provided by law, by the rules and regulations prescribed by the Director of Safety and as may be required by the Chief of the Division of Fire.
      (2)   Fire Cadet First Class officers, who shall be officers with more than eighteen months, but less than two years, of service. Their duties shall be as provided by law, by the rules and regulations prescribed by the Director of Safety and as may be required by the Chief of the Division of Fire.

      (3)   Fire-Fighters Class I, who shall be officers with two years or more service. Their duties shall be as provided by law, by the rules and regulations prescribed by the Director of Safety and as may be required by the Chief of the Division of Fire.
   (l)   Fire Prevention Bureau. There is hereby established a Fire Prevention Bureau. Such Bureau shall be directly under the Chief of the Division of Fire who shall have the power to delegate such personnel within such Bureau and such supervision as are required. The duties of a member of the Bureau shall include administering oaths, making arrests and entering, for the purpose of examination, any building which, in his or her opinion, is in danger from fire. In addition, such officer shall be present at all fires, investigate the cause thereof, examine witnesses, compel the attendance of witnesses and the production of books and papers, and do and perform all other acts necessary to the effective discharge of such duties. Additional duties may be prescribed by the Chief of the Division of Fire or his or her duly authorized representative.
