If Ohio R.C. Sections 4116.01 through 4116.04 or substantially equivalent State law provisions are found to be lawful by a court of competent jurisdiction, then Sections 212.02 and 212.03 of this chapter shall not apply to any public improvement project which includes State funds appropriated for the purposes of that public improvement.
